Infringement Reporting Procedures. If you own copyright, trademark, patent, or other intellectual property rights (“IP Rights Owner”), or if you are an agent authorized to act on the IP Rights Owner’s behalf (“Authorized Agent”), and you have a good faith belief that material or products on the Site infringe the IP Rights Owner’s copyright, trademark, or other intellectual property rights, and you would like to bring it to SECURE THE BAG ACADEMY attention, you can report your concern(s) by submitting your complaint to [email protected].

Reservation Of Rights

You acknowledge and agree that the Website (“service”) is provided under license, and not sold, to you. You do not acquire any ownership interest in the service under this Agreement, or any other rights thereto other than to use the service in accordance with the license granted, and subject to all terms, conditions, and restrictions, under this Agreement. Company shall retain its entire right, title, and interest in and to the Application, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto, except as expressly granted to you in this Agreement.

Communications

SECURE THE BAG ACADEMY application may use GPS locator capabilities to identify your current location. If you provide a mobile phone number, you hereby expressly consent to receive SMS text messages from SECURE THE BAG ACADEMY regarding the Services and as otherwise described in our privacy policy. The communication standards for the Services include but are not limited to SMS, GPS, and web-based browser technology. In order to use the SMS-based Services, you must maintain an active account with a carrier of electronic communications through mobile devices and you may not use a prepaid cellular phone to access the Services.

Modifications to Services

SECURE THE BAG ACADEMY reserves the right, in its sole discretion, to modify the Services from time to time and without notice, including, without limitation, by removing, adding, or modifying portions of the SECURE THE BAG ACADEMY service. SECURE THE BAG ACADEMY shall have no liability to you for any of the foregoing actions. If you object to any such changes, your sole recourse shall be to cease using the Services. Continued use of the Services following any such changes shall indicate your acknowledgment of such changes and satisfaction with all the Services.

Third Party Materials

The service may display, include, or make available third-party content (including data, information, applications, and other products, services, and/or materials) or provide links to third-party websites or services, including through third-party advertising (“Third-Party Materials”). You acknowledge and agree that Company is not responsible for Third-Party Materials, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. Company does not assume and will not have any liability or responsibility to you or any other person or entity for any Third-Party Materials. Third-Party Materials and links thereto are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

Fraudulent Actions of Users

SECURE THE BAG ACADEMY is not liable for any losses relating to chargebacks, fraudulent charges, or other actions by any User that are deceptive, fraudulent or otherwise invalid (“Fraudulent Actions”). By using the Services, you hereby release SECURE THE BAG ACADEMY from any liability arising from Fraudulent Actions. You will also use the best efforts to promptly notify us of any Fraudulent Actions which may affect the Services. SECURE THE BAG ACADEMY reserves the right, in its sole discretion, to terminate the account of any User that engages in, or enables any other User to engage in, Fraudulent Actions.

Severability

If any of the provisions, or portions thereof, of this Agreement, are found to be invalid under any applicable statute or rule of law, then, that provision (or portion thereof) notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted.

Assignment

This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned, or delegated in any manner by User, but may be freely transferred, assigned, or delegated by SECURE THE BAG ACADEMY.

Entire Agreement

This Agreement and our Privacy Policy constitute the entire agreement between you and Company with respect to the service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the service.

Waiver

Any waiver of any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right

Governing Law

These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the Province of (state) and the laws of (Country), as applicable.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect.
